Overcoming The Challenges Of Industry And Government Regulations

At WatskyLaw, we represent clients in the defense of federal, state and local administrative enforcement actions. We have 30 years of experience dealing with municipal agencies, boards and commissions at all levels of government. When roadblocks arise during the permitting process, we’ll work with you to navigate the process and overcome all obstacles encountered in local proceedings, including before conservation commissions for wetlands permits; planning boards for subdivisions, ANR (Approval Not Required) plans, site plan approvals and special permits; zoning boards of appeals to challenge building inspector/zoning enforcement officer decisions and seek special permits and variances; and boards of health for waste water/septic and water supply permits.

State agency work includes Massachusetts Department of Environmental Protection (Mass DEP) oversight of: Wetlands Protection Act permits and enforcement; Waterways Program (Chapter 91) licensing of activities in public trust land – intertidal waterways and Great Ponds; Title 5 regulation of septic systems; hazardous waste (Chapter 21E and the Massachusetts Contingency Plan [MCP] regulations); air pollution, noise and other programs; and other state agency regulatory programs such as rare species land protection and permitting by the Natural Heritage and Endangered Species Program (NHESP).

We also provide preparation and recording of conservation restrictions and other restrictive covenants reviewed and approved by the Executive Office of Environmental And Energy Affairs (EOEEA), which oversees conservation restrictions (CRs) that are commonly used to provide permanent land protection as a condition of development permits. From filing to compliance and beyond, you can count on us to help bring your project to completion.
